(hereinafter "Windstream"). Since the filing of the petition, the applicants have applied for approval of employment. Conditions of employment include, compensation on a basis consistent with language contained in Windstream's contract with the debtor. Applicants have adjudicated the consumer claim in arbitration, and successfully secured an award of damages for debtor. Applicants have additionally secured an award for attorney's fees and expenses through arbitration. Applicants are now filing this present application for the Bankruptcy Court's approval of compensation awarded by the Arbitrator. Davis & Norris, counsel in the arbitration, were awarded $16,750.00 in attorneys' fees and $2,895.00 in expenses pursuant to the order of the arbitrator, in the representation of debtor, Stacy Hallman. Stacy Hallman was also awarded $2,240.52 by the Arbitrator which was automatically increased to $3,000.00 pursuant to contract. The fees requested by the applicants were awarded after briefing and consideration by the Arbitrator. The debtor needed the assistance of Applicants for prosecution of the claims the debtor has against Windstream. The applicant represented the debtor through all stages of litigation, including investigation and preparation prior to filing of the action, service of process, motion practice, discovery, and eventually at the final arbitration hearing. The period of time for which compensation is sought covers the effective date of employment through the final award of the Arbitrator. The applicants have received nothing in this matter to date. This application is the first and is the final application of the applicants in this matter. Any compensation for the applicants awarded hereunder may be shared with other members/attorneys of the applicants' law firm. The referring associated law firm in this action, Beckum and Kittle, LLP, has waived any fees in this matter, and therefore will not share in any recoveries. Any compensation to be paid to the applicants will be from the recovery described in this application. The person who performed the services for which compensation is sought are: of the law firm of Davis & Norris, LLP, Wesley W. Barnett, and other members or staff of the firm. All attorneys have litigation experience, having been admitted to the Alabama bar in Alabama. All have entered into such legal representations on the basis of contractual recovery, usually with a similar fee involved. For similar services, it is the opinion of the applicants that prevailing market rates in the relevant professional community are closely in line for professionals whose skills, experience and reputation reasonably compare to the individuals who performed the services for which compensation is requested, whether related to a bankruptcy case or not. The Arbitrator evaluated the reasonableness of fees and expenses awarded after opposition by the Respondent in the arbitration proceeding, Windstream. The contract under which the arbitration proceeded requires that the arbitration remain confidential. Counsel has disclosed only information that was required to seek approval of the foregoing fee. If the Court requires review of the awards in the arbitration proceeding, Counsel requests that an in-camera review take place at the hearing of this application.
