Page 1 of 3 Again, please let us know whether Lenovo is opposed to the mo1on for leave, so that we can get the mo1on on file today. Best, Larry Larry D. But in any event, please explain why Plaintiff needs four pages to address this purported issue, especially when Plaintiff has already submitted over 20 pages of supplemental briefing. The reply will address a single legal issue: the burden of proof when deciding a personal jurisdic1on mo1on aRer limited jurisdic1onal discovery, but without an eviden1ary hearing. Lenovo's brief incorrectly states the burden that applies in this case under Federal Circuit precedent. See Celgard, LLC v. SK Innova7on Co., Ltd., 792 F.3d 1373, 1378 (Fed. Cir. 2015) (rejec1ng "the excep1on in Pieczenik" and con1nuing to apply a prima facie burden, even aRer jurisdic1onal discovery, when "the par1es do not agree on the jurisdic1onal facts" and "no jurisdic1onal hearing [wa]s conducted"). We think it's important to address this threshold issue well in advance of the mo1ons hearing. Please let me know as soon as possible if Lenovo is opposed to the mo1on for leave. Best, Larry Larry D.
