On August 12, 2019, Plaintiff filed its Opposed Motion for Entry of Form Protective Order ("Plaintiff's Motion") [Dkt. No. 138]. On August 19, 2019, Defendants filed their Response in Opposition to Plaintiff's Motion along with a Cross-Motion for Entry of Defendants' Proposed Protective Order ("Defendants' Cross-Motion") [Dkt. No. 140]. On August 23, 2019, Plaintiff filed its Reply in Support of Plaintiff's Motion with its Response in Opposition to Defendants' Cross-Motion [Dkt. No. 145]. 4844-8498-4739 2. Defendants seek leave to file a sur-reply in opposition to Plaintiff's Motion in conjunction with their reply in support of Defendants' Cross-Motion, which is due today (August 30, 2019). Defendants further seek leave to exceed the page limits required under the Local Rules. 3. Local Rule CV-7(f)(3) limits a reply in support of a nondispositive motion to five (5) pages, exclusive of the caption, signature block, certificates and accompanying documents. Under the Local Rule, Defendants' reply in support of Defendants' Cross-Motion is approximately 10 pages. 4. Defendants' pleading, however, combines both their reply in support of Defendants' Cross-Motion and their sur-reply in opposition to Plaintiff's Motion. The facts and issues involved in both motions are intertwined. Defendants submit that the most efficient way for the parties to present the issues and for the Court to ultimately resolve them is for Defendants to file a singular, comprehensive pleading that address both pending motions; however, that pleading is necessarily longer than five (5) pages. 5. The undersigned counsel conferred with Plaintiff's counsel who confirmed that Plaintiff does not oppose Defendants' request for permission to file a sur-reply or to exceed the page limits normally set for a reply brief.
