1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 SEDALIA BENTON, 7 Case No. 15-cv-03500-JSW Plaintiff, 8 v. ORDER GRANTING REQUEST FOR 9 EXTENSION OF TIME REAL ESTATE FINANCIAL SERVICES, 10 INC., et al., Re: Docket No. 7 11 Defendants. 12 Northern District of California United States District Court 13 On July 30, 2015, the Court issued an Order denying the application for a temporary 14 restraining order, filed by Plaintiff, Sedalia Benton. In that Order, the Court also denied Ms. 15 Benton's application to proceed in forma pauperis and dismissed the complaint with leave to 16 amend. The Court directed Ms. Benton to file an amended complaint and a renewed application to 17 proceed in forma pauperis by August 28, 2015. 18 Ms. Benton did not file an amended complaint by that deadline. On August 31, 2015, 19 however, she filed a motion to extend the deadline for a period of thirty days, ostensibly on the 20 basis that she was in the hospital. (See generally Docket No. 7.) In light of Ms. Benton's pro se 21 status, the Court shall grant her request. Although Ms. Benton is representing herself, she is 22 expected to comply with the Federal Rules of Civil Procedure, the Local Rules, this Court's 23 standing orders, and any deadlines set by the Court. See, e.g., Ghazali v. Moran, 46 F.3d, 52, 54 24 (9th Cir. 1995) (noting that pro se litigants are bound by the rules of procedure), cert denied, 516 25 U.S. 838 (1995); Civil L.R. 3-9(a). Therefore, if Ms. Benton seeks any extensions of time in the 26 future, she is admonished to file such requests sufficiently in advance of a deadline for the Court 27 to rule on the request before the deadline expires. 28 Accordingly, Ms. Benton shall file an amended complaint and renewed motion to proceed 1 in forma f paupeeris by no latter than Octtober 1, 20155. If Ms. Beenton fails too file an ameended 2 com mplaint by th hat date, the Court shall dismiss thiss action withhout prejudicce. 3 The Co ourt once agaain advises Ms. M Benton tthat a Handbbook for Pro Se Litigantss, which 4 con ntains helpfu ul informatio on about proceeding withhout an attorrney, is availlable througgh the 5 Court's website or in the Clerk's C officee.
