IN THE UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF TEXAS WACO DIVISION BICAMERAL LLC, Plaintiff Case No. 6:18-cv-00294-ADA v. JURY TRIAL DEMANDED NXP USA, INC., NXP SEMICONDUCTORS N.V. and NXP B.V., Defendants. JOINT MOTION TO EXTEND CLAIM CONSTRUCTION BRIEFING SCHEDULE Plaintiff Bicameral hereby notifies the Court that Bicameral has reached an agreement-in- principle with a third party that would extend a license to NXP products accused of infringing U.S. Patent No. 6,321,331 (the "'331 Patent") in this action. Bicameral is currently working with the third party to finalize a written agreement. Since the '331 Patent comprises seven out of the eight disputed claim terms in this action, the parties respectfully request the Court to extend the claim construction briefing schedule by 30 days as follows: Milestone Current Date New Date Parties file Reply claim construction briefs September 17, 2019 October 17, 2019 Parties submit Joint Claim Construction September 23, 2019 October 23, 2019 Statement, optional tutorials, and consolidated briefing collated by Opening, Response, and Reply Markman Hearing November 21-22, November 22, 2019 2019 The extension requested by the parties would promote judicial economy and conserve the parties' resources by eliminating most of the disputed terms from claim construction. The 30- day extension will allow approximately thirty days between the submission of the parties' -1- tutorials and consolidated briefing and the date currently set for the Markman hearing. The parties also anticipate that the Court will be able to hear arguments over the single remaining claim term in a single morning or afternoon session. The remainder of the dates in the Court's Agreed Amended Scheduling Order dated July 9, 2019 (Dkt. No. 41) remain unaffected.
