IN THE UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF TEXAS WACO DIVISION BICAMERAL LLC, Plaintiff Case No. 6:18-cv-00294-ADA v. JURY TRIAL DEMANDED NXP USA, INC., NXP SEMICONDUCTORS N.V. and NXP B.V., Defendants. JOINT STIPULATION OF PARTIAL DISMISSAL Plaintiff Bicameral LLC ("Bicameral") and Defendants NXP USA, Inc., NXP Semiconductors N.V., and NXP B.V. (collectively, "NXP"), through their undersigned counsel, stipulate as follows: WHEREAS, on October 2, 2018, Bicameral filed its Complaint for Patent Infringement, which included Bicameral's claims of patent infringement of U.S. Patent No. 6,008,727 (the "'727 Patent") (Dkt. No. 1). WHEREAS, on January 11, 2019, NXP filed its Answer and Counterclaims (Dkt. No. 23). NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, between Bicameral and NXP that: (1) Bicameral's Count I in the above-captioned action relating to the '727 Patent is hereby dismissed with prejudice by agreement of Bicameral and NXP pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure; (2) NXP's First and Second Counterclaims in the above-captioned action are hereby -1- dismissed in part, as to the '727 Patent only, with prejudice, by agreement of Bicameral and NXP pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure; (3) Each Party reserves the right to seek recovery of its respective costs, expenses, and attorneys' fees associated with litigating the claims dismissed herein, notwithstanding the dismissals; and (4) This stipulation does not extend to any other patent owned or controlled by Bicameral either expressly or by implication, estoppel or otherwise.
