Levine, declare as follows: 2 1. I am an attorney duly admitted to practice before this Court and am a partner at 3 Pritzker Levine LLP, Class Counsel and one of law firms representing plaintiffs and the certified 4 classes in this litigation. I have personal knowledge of the facts stated herein and, if called upon to 5 do so, could and would testify competently thereto. 2. Plaintiffs hereby request that the following documents be filed under seal, for the 6 reasons set forth below: 7 a) Exhibit A to the June 9, 2020 Declaration of Brian Devery of Angeion Group, 8 LLP. 9 3. Pursuant to §§ 2.2 and 2.4 of the Revised Stipulated Protective Order ("Order") (ECF 10 No. 67), a party may designate as "Confidential" information that qualifies for protection under 11 Federal Rule of Civil Procedure 26(c). Pursuant to § 7.2 of the Order, disclosure of such information 12 may be allowed only to the categories of persons and under the conditions described in the Order. 13 4. The document that has been designated as Confidential by plaintiffs is as follows: 14 New Document Sought to Designating Party and Prior Orders re. Sealing 15 be Sealed Confidentiality Designation 16 Exhibit A: List of Exclusion Plaintiffs – HIPAA- N/A Requests from Class protected information. 17 Members. 18 5. On June 8, 2020, I conferred with counsel for CVS in advance of filing of this 19 administrative motion to seal. CVS's counsel stated that CVS does not object to the sealing of 20 Exhibit A to the Devery Declaration. 21 6. The information contained in Exhibit A to the Devery Declaration includes the names 22 of all class members who have requested to be excluded from the certified classes. This information 23 should be protected from public disclosure because it links the identities of individuals with the 24 provision of medical services, which is HIPAA-protected information. 25 26 27 DECL.
