Defendants' counsel is instructed to file five (5) business days prior to the 9 compliance hearing the trial schedule in the In re Opiod Litigation, Index No. 400000/2017, as well 10 as identifying their availability and unavailability in May 2020. Based on defendants' counsel's 11 response, the Court will determine whether, and when, to hold the hearing on the motions in limine 12 Northern District of California United States District Court 13 and proposed jury instructions. 14 Finally, with respect to the issue of the date of the jury selection, the Court advises the 15 parties' that the Court's Standing Order re: Pretrial Instructions in Civil Cases Section 3(h)(i) 16 provides that "jury selection may occur on the Wednesday or Friday preceding the Monday trial 17 date to allow for a full day of voir dire." The Court assumes that the parties were on notice of this 18 provision when they selected the August 10, 2020 date. If the August 10, 2020 date does not work 19 in light of this provision, the parties may jointly request to move the trial date to August 17, 2020.1 20 IT IS SO ORDERED. 21 Dated: March 10, 2020 22 _______________________________________ 23 YVONNE GONZALEZ ROGERS UNITED STATES DISTRICT JUDGE 24 25 1 The Court notes that the February 18, 2020 docket entry – noting jury selection beginning 26 August 10, 2020 – cited by defendants is an internal entry setting dates on the Court's internal and public calendars. Such an entry is not an indication of the Court's ruling as to the date of the jury 27 selection. This is so where the Court's standing order makes clear that jury selection generally 28 happens the week prior to the set trial date. 2
