JOINT SUBMISSION RE TRIAL DATE 9 AND PRETRIAL SCHEDULE 10 CVS Pharmacy, Inc. 11 Defendant. 12 13 14 Pursuant to the Court's May 22, 2020 Order (Dkt. No. 456), the parties hereby submit this joint 15 statement regarding a new date for the trial and the proposed pretrial schedule. 16 The parties, through their counsel, met and conferred about the trial date and pretrial schedule 17 on June 1 and 4, 2020. Plaintiffs' counsel are available and prepared to commence trial in February 18 2021. CVS's counsel has actual and potential trial rescheduling conflicts in that time period. 19 Accordingly, the parties have agreed that, assuming the Court is available, trial should be rescheduled 20 to start on Monday, May 10, 2021. Plaintiffs are willing to defer trial until May 2021, but request that 21 the May 2021 trial date be a firm date, with no further continuances granted absent extraordinary 22 circumstances. CVS's counsel fully understands that this case must be tried and believes a May 10, 23 2021 (or other May date) can be protected from conflicts, and counsel will make all efforts to do so. 24 Lead counsel for CVS notes, however, that the presiding judge in In re Opioid Litigation, No. 25 400000/2017 (Nassau Cnty, NY Supreme Ct.) has yet to reschedule the trial date in that matter. 26 With respect to the pretrial schedule, the parties propose that the Court first determine the new 27 trial date and the final pretrial conference date.
