West § § Unsworn Declaration of Willi am M. Clanton ____________________ I, William M. Clanton, per 28 U.S.C. § 1746, declare under penalty of perjury as follows: 1. I represent Plaintiff in this matter. 2. On July 2, 2019 after filing this action, I mailed a notice of suit and request to waive summons to Defendants at the addresses they provided to the Texas Secretary of State and as found on the Texas Comptroller of Public Accounts website. 1 3. In spite of defendant ha ving received the waiver, as evidenced by calls from opposing counsel, my office never received an executed waiver of summons. 4. Counsel for Defendant called to engage in settlement negotiations. 5. On August 22, 2019 I requeste d the Clerk issue summons. 1 h ttp s: // m y cp a. cp a. st at e. tx .u s /co a/ 6. On August 27, 2 019 I provided these summonses to a process server. 7. I searched for the name "James West" on the Harris County Appraisal District's website 2 and provided what seemed like likely addresses to Pronto Process. 8. The process server sent my office the emails attached to this motion. 9. This motion is filed to pro vide time for the process server to track down and attempt service at another address.
