No. 3316) is GRANTED as set forth below. The creation of the CBFC, the funding and disbursements made from the MDL 1507 Fee and Cost Trust Account ("Common Benefit Fund"), and the creation of a "Holdback Fund" were discussed in this Court’s August 1, 2014 Order.1 The CBFC has unanimously requested a fourth disbursement from the Common Benefit Fund that is based on the percentage allocation to firms performing common benefit work that was the basis of the August 1, 2014 Order. There were no objections to the allocations contained in the August 1, 2014 Order. The funds available for distribution total $164,000. However, a holdback fund must be maintained to ensure that trust expenses are paid. Accordingly $10,000 is exempted from distribution and must remain in the fund at this time. The distribution to Hissey Kientz, LLP includes necessary and reasonable fees incurred by Lead Counsel, Erik Walker’s work in preparing motions for distribution of funds and other work connected to the Common Benefit Fund in the amount of $11,870. This work occurred after the settlement agreement was reached between the CBFC and Hissey Kientz, LLP that resolved the latter’s earlier CBFC work. The Court orders the Trustee of the MDL 1507 Fee and Cost Trust Account to pay forthwith the following amounts to each of the corresponding law firms below: 1 Doc.
