ORDER DIRECTING FILING OF BRIEFS Before the Court is the status of this case. On November 22, 2019, Defendant filed an Answer (Docket Entry 7), and a certified copy of the transcript of the administrative proceedings (Docket Entry 9) was entered onto record on November 25, 2019. Accordingly, it is hereby ORDERED that counsel for both parties submit briefs - not to exceed 20 pages - in compliance with the following requirements: (1). On or before January 15, 2020, Plaintiff must file and serve a brief, setting forth all errors which Plaintiff contends entitle her to relief. (2). On or before March 5, 2020, Defendant must submit and serve a brief, which responds specifically to each issue raised by Plaintiff. The parties are notified that substantive motion practice, in accordance with Federal Rule of Civil Procedure 12(c) (motion for judgment on the pleadings), and Federal Rule of Civil Procedure Rule 56 (summary judgment), are not appropriate in this action. While Plaintiff may seek remand as a remedy in her appeal brief, she should not file a separate motion to remand, or a motion for summary judgment. SIGNED on November 26, 2019.
