TOTAL: 23 Minutes PROCEEDINGS: MOTION HEARING Court in session. This hearing was scheduled to consider Plaintiffs’ Rule 23 motion for class certification. Plaintiffs have, however, since voluntarily withdrawn the motion with respect to the common law unpaid wage claims. For the reasons stated on the record, the Court grants Plaintiff’s motion with respect to class certification as to the WARN Act claims (Dkt. 25), finding that the prerequisites for class certification under Rule 23 have been met. A written order will be entered. The Court directs Plaintiffs’ counsel to file a proffer of the experience and background of counsel’s law firm and, if it is newly formed, the attorneys with the firm who will be participating by way of their class action background. The Court discusses the next steps with the attorneys. Court adjourned.
