Certify, ECF No. 26, Defendant's Response in Opposition, Def.'s Certify Resp., ECF No. 28, and Plaintiff's Reply in Support, Pl.'s Certify Reply, ECF No. 29. In Defendant's Response in Opposition, it stated "[s]everal Plaintiffs" agreed to a Confidentiality, Nondisclosure, Non-solicitation, Non-Competition and Inventions Agreement contained in Nixon's Employee's Handbook. Def.'s Certify Resp. at pp. 6-7. Defendant is hereby ORDERED to file with the Court in the next seven (7) days evidence indicating whether Jayme Peery agreed to the Confidentiality, Nondisclosure, Non- solicitation, Non-Competition and Inventions Agreement contained in Nixon's Employee's Handbook or a statement why such evidence cannot be produced. If Plaintiff desires to respond, he is directed to move for leave to do so and attach the proposed response / statement as an exhibit to the motion for leave in compliance with Local Rule CV-7(b).
