JOINT MOTION TO EXTEND TIME TO RESPOND TO PLAINTIFF'S THIRD AMENDED COMPLAINT AND TO SET A BRIEFING SCHEDULE FOR THE MOTION TO DISMISS Defendants Adtalem Global Education Inc. f/k/a DeVry Education Group, Inc. ("DeVry"), Daniel Hamburger, Richard M. Gunst, Patrick J. Unzicker, and Timothy J. Wiggins (collectively, the "Individual Defendants"), by and through their attorneys, Arnold & Porter Kaye Scholer LLP, and lead plaintiff Utah Retirement Systems ("Lead Plaintiff"), by and through its attorneys, Labaton Sucharow LLP and Wexler Wallace LLP, move this Court pursuant to Fed. R. Civ. P. 6(b)(1) for an order (a) extending Defendants' time to answer, move, or otherwise respond to the Third Amended Complaint and (b) setting forth the briefing schedule for the contemplated motion to dismiss the Third Amended Complaint. In support of this joint motion, the Parties state as follows: 1. On December 6, 2017, the Court entered a Memorandum Opinion and Order granting Defendants' motion to dismiss the Second Amended Class Action Complaint for Violations of the Federal Securities Laws without prejudice. The Court permitted Lead Plaintiff to file an amended complaint by January 15, 2018. (ECF No. 80.) Case: 1:16-cv-05198 Document #: 85 Filed: 02/07/18 Page 2 of 5 PageID #:1502 2. On December 15, 2017, with the agreement of Defendants, Lead Plaintiff filed an Agreed Motion for Extension of Time to File an Amended Complaint. (ECF No. 81-82.) 3. On December 19, 2017, the Court granted Lead Plaintiff's motion and extended its deadline to file an amended complaint to January 29, 2018. (ECF No. 83.) 4. On January 29, 2018, Lead Plaintiff filed the Third Amended Class Action Complaint for Violations of the Federal Securities Laws ("TAC"). (ECF No. 84.) 5. Counsel for the Parties have conferred regarding the briefing schedule for Defendants' contemplated motion to dismiss the TAC and jointly move this Court for the entry of an order as follows: 6. Defendants shall answer, move to dismiss or otherwise respond to the TAC on or before March 30, 2018; 7. If Defendants move to dismiss, Lead Plaintiff shall file a brief in opposition to that motion on or before May 24, 2018; 8.
