Defendant moves the Court to withdraw Mark A. McNitzky as local counsel of record for Defendant. Mr. McNitzky resigned his employment with the law firm of Ogletree, Deakins, Nash, Smoak & Stewart, P.C., effective December 20, 2019. Defendant further moves the Court to allow Tiffany Cox Stacy and Kelly E. Preston, also of Ogletree Deakins, Nash, Smoak & Stewart, P.C., 112 E. Pecan Street, Suite 2700, San Antonio, Texas 78205, to substitute in as local counsel of record for Defendant. Both Ms. Cox Stacy and Ms. Preston are members of the Federal Bar in good standing. Note this substitution is only for purposes of local counsel. Marja-Liisa Overbeck, 1 Martin Bern, Catherine N. Grech, and Malcolm A. Heinicke of the law firm of Munger, Tolles & Olson LLP, remain as lead counsel for Defendant. II. Counsel for Plaintiffs do not oppose the withdrawal and substitution of local counsel requested in this Motion. Good cause exists for the withdrawal and substitution of local counsel requested in this Motion. Any trial setting or scheduling order in place will not be affected by the requested withdrawal and substitution of counsel. Defendant Wells Fargo Bank, N.A., does not request this substitution for the purpose of delay, but so that justice may be served. III. WHEREFORE, PREMISES CONSIDERED, Defendant Wells Fargo Bank, N.A., requests that the Court grant its Unopposed Motion to Withdraw and Substitute Local Counsel, and that Tiffany Cox Stacy and Kelly E. Preston be substituted as local counsel of record in place of Mark A. McNitzky.
