JOINT UNOPPOSED MOTION TO EXTEND THE PAGE LIMIT FOR DEFENDANT'S AND INTERVENOR-DEFENDANTS' MOTION TO DISMISS AMENDED COMPLAINT Defendant Board of Education of Township High School District 211 ("Defendant") and Intervenor-Defendants Students A, B, C, by and through their parents and legal guardians Parents A, B, and C, and the Illinois Safe Schools Alliance ("Intervenor-Defendants"), respectfully request this Court to extend the page limit for the memoranda in support of Defendant's and Intervenor-Defendants' motions to dismiss, which are due on April 2, 2018. In support of this motion, the Defendant and Intervenor-Defendants state as follows: 2492361.1 Case: 1:16-cv-04945 Document #: 198 Filed: 03/23/18 Page 2 of 6 PageID #:2938 1. On February 15, 2018, Plaintiffs filed a five-count, sixty-three page Amended Complaint. The Amended Complaint alleges that the District's provision of facility access for transgender students violates Title IX, 20 U.S.C. § 1681(a); the Fourteenth Amendment's Due Process Clause; and the Illinois Religious Freedom Restoration Act, 775 ILCS 35/15. 2. Defendant and Intervenor-Defendants intend to file separate motions to dismiss the Amended Complaint. 3. Given the number of allegations, the evolving case law on the issues raised by this lawsuit, and the lengthy allegations in the Amended Complaint, Defendant and Intervenor- Defendants request leave to exceed this Court's 15-page limit in their forthcoming memoranda in support of their motions to dismiss. Defendant and Intervenor-Defendants request leave to each file a memorandum up to 30 pages in length. 4. Counsel for Plaintiffs do not oppose this request. 5. A proposed Order granting this request is attached.
