ORDER REGARDING MOTION FOR SENTENCE REDUCTION PURSUANT TO 18:3582(c)(2) - granting {{27}} motion to reduce sentence pursuant to crack cocaine Amendment 706 and adopting {{28}} the Stipulation of the parties. Defendant's previously imposed sentence o f imprisonment (as reflected in the last judgment issued) of 121 months is reduced to 120 months. Except as provided above, all provisions of the judgment dated 12/2/04 shall remain in effect as to Lamar E. Dunn (1). Ordered by Senior Judge Lyle E. Strom. (4 Certified copies to USM)

LAMAR DUNN,) ORDER) Defendant.) ______________________________) This matter is before the Court on defendant's motion for sentence reduction (Filing No. 27), and the stipulation of the parties (Filing No. 28). The retroactive amendment to the cocaine base guideline changes the total (final) offense level from 29 to 27. The government and defense agree that the new sentence should be one hundred twenty (120) months imprisonment, based on the prior computation of specific offense characteristics, adjustments, mandatory minimum and any departures. IT IS ORDERED that said motion is granted and the stipulation of the parties is approved and adopted; the sentence of the defendant is reduced to a term of one hundred twenty (120) months. He shall receive credit for all time served.
