SA-19 CR 0227 FB V. § § ALMA LUGO § DEFENDANT'S MOTION FOR A BOND RECONSIDRATION HEARING AND REQUEST FOR RELEASE TO THE HONORABLE HENRY J. BEMPORAD, UNITED STATES MAGISTRATE JUDGE FOR THE WESTERN DISTRICT OF TEXAS: Defendant Alma Lugo asks the Court to hold a bond reconsideration hearing and thereafter, release her on pretrial bond with conditions of release in place based on a recent change in circumstances. I. Ms. Alma Lugo is charged with three count indictment for Possession with the intent to distribute 500 grams or more of a mixture or substance containing methamphetamine and Aiding and Abetting in violation of 21 U.S.C. § 841 (a)(1), § 841 (b)(1)(A)(viii) & 18 U.S.C. § 2. Ms. Alma Lugo is also charged with Conspiracy to Possess with the intent to distribute 500 grams or more of a mixture or substance containing methamphetamine in violation of 21 U.S.C. § 841 (a)(1), § 841 (b)(1)(A)(viii) . II. On March 29, 2019 Honorable Judge Henry J. Bemporad granted an unsecured bond, thereafter, Ms. Lugo was placed on pretrial supervision and was ordered to participate in the Alpha Home in patient Substance Treatment program in San Antonio, Texas. On June 13, 2019, a hearing was held to revoke Ms. Lugo's bond. The Court Ordered that Ms. Lugo's bond be revoked and she be detained. Judge ordered revocation of bond due to alcohol consumption at Alpha home. At the time of the bond revocation, Counsel for Defense orally requested defendant to be allowed to participate in treatment facility in Temple, Texas. At the time of request, Ms. Lugo was unable to attend Temple facility because her wife was being treated at the same facility. Change in circumstances today are that wife has completed treatment in Temple Facility and Ms. Lugo is now able to participate in program pending approval from the Court. III. For the reasons stated above, Ms. Lugo asks that the Court to set her case for reconsideration of detention hearing, and thereafter, release her on pretrial bond with conditions of release in place.
