1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 In Re SHAWNCEY BLAKE, 7 Case No. 15-cv-03738-HSG (PR) Plaintiff. 8 ORDER OF DISMISSAL 9 10 11 12 On August 17, 2015, the Clerk filed as a new prisoner action a letter from plaintiff Northern District of California United States District Court 13 complaining of civil rights violations at the Santa Clara County Jail. On that same date, the court 14 notified plaintiff in writing that the action was deficient because he did not file an actual complaint 15 or pay the requisite filing fee or, instead, submit a signed and completed court-approved in forma 16 pauperis application. Plaintiff was advised that failure to file the requested items within 28 days 17 would result in dismissal of the action. 18 Plaintiff instead has filed a response explaining that he did not intend his original letter to 19 be filed as a new action in this court. Good cause appearing, the case is DISMISSED without 20 prejudice. The Clerk is instructed to close this matter as improvidently opened.
