- UNITED STATES DISTRICT COURT I*1..IbIIP WESTERN DISTRICT OF TEXAS SAN ANTONIO DIVISION DEC 1 6 2019 CLERK, U.S. DISTRICT COURT PABLO E. GAY and ANNA J. SUBIA aka § WESTERN DISTRI OF T XAS ANNA J. SUBIA-GAY, § DE CLERK Plaint ffs, § § v. § Civil Action No. 5:19-cv-00697-OLG § QUICKEN LOANS INC., § Deftndant. § ORDER On this day, the Court considered Defendant Quicken Loans Inc.'s Unopposed Motion for Leave to Amend Answer and Affirmative Defenses (docket no. 16). Having reviewed the Motion, the Court finds that it should be GRANTED. Federal Rule of Civil Procedure 15 gives broad latitude to amend pleadings before trial. Under Rule 15(a)(2), the Court "should freely give leave" to amend "when justice so requires." This rule "evinces a bias in favor of granting leave to amend," Rosenzweig v. Azurix Corp., 332 F.3d 854, 863 (5th Cir. 2003), and absent a significant reason, "such as undue delay, bad faith, dilatory motive, or undue prejudice to the opposing party, 'the discretion of the district court is not broad enough to permit denial'." Martin's Herend Imports, Inc. v. Diamond & Gem Trading United States ofAm. Co., 195 F.3d 765, 770 (5th Cir. 1999) (quoting Dussouy v. Gulf Coast mv Corp., 660 F.2d 594, 598 (5th Cir. 1981)). Given Rule 15's bias towards permitting leave to amend, the Court finds no substantial reason that would justify denying Defendant the opportunity to amend its answer. As a result, the Court finds that leave should be GRANTED. IT IS THEREFORE ORDERED that Defendant Quicken Loans Inc.'s Unopposed Motion for Leave to Amend Answer and Affirmative Defenses (docket no. 16) is GRANTED. 1 Defendant's First Amended Answer, docket no. 16-1, is accepted for filing as the operative answer. It is so ORDERED. SIGNED this I day of December, 2019. ORLANDO L. GARCIA CHIEF UNITED STATES DISTRICT JUDGE
