SEARS CODER: Sally Sears Coder and Arthur Burke 5 on behalf of defendants. 6 THE COURT: Good morning. 7 You are here for status this morning. You are in the 8 midst of briefing the motion to dismiss on the one count. 9 What is the status of discovery? 10 MS. MILLER: You are correct, your Honor. We filed 11 our response. I actually brought a courtesy copy this morning 12 for your Honor. 13 THE COURT: You can hand that to Katie. Thank you. 14 (Document tendered to the Court.) 15 MS. MILLER: Defendant's response, I believe, is due 16 February 9th. Both sides have served both interrogatories and 17 written document requests and responded to those. The parties 18 have had two meet-and-confers to discuss some of the issues. 19 We expect that we'll have at least one more to finish up those 20 discussions. There will be some preliminary exchange of some 21 baseline discovery this week, and then we expect to continue 22 those meet-and-confer discussions once those materials are 23 produced. 24 We have served a Rule 30(b)(6) deposition notice, but 25 have agreed to temporarily hold that in abeyance pending a Case: 1:16-cv-05486 Document #: 64 Filed: 03/07/17 Page 3 of 4 PageID #:450 3 1 production from the defendants this week. We have not 2 withdrawn it. We are simply holding the date in abeyance 3 pending that production. 4 THE COURT: And settlement? Have you discussed 5 settlement? 6 I know when you were here last time, I raised the 7 issue of whether or not you wanted to try to resolve this 8 early on since you know at least a piece of the case is going 9 forward. 10 MS. MILLER: Certainly. 11 The senior executives from both companies met about a 12 week-and-a-half ago, give or take. I think it's fair to say 13 that discussions are ongoing. There's no resolution as of 14 yet, but we are hopeful that the conversations will continue. 15 If it seems or gets close to the fact that we either could use 16 your assistance or Judge Finnegan's and/or we've reached an 17 impasse, we will promptly let the Court know. 18 THE COURT: Are you in agreement with those 19 representations? 20 MR. BURKE: We are, your Honor. 21 THE COURT: Keep in mind -- you probably heard me say 22 this before -- magistrate judges are a bit backed up these 23 days, so a referral will likely take two months or so to get 24 in for a settlement conference.
