DocketBird Privacy Agreement

Effective Date: July 2, 2020

Mink LLC collects certain information through its website, located at www.docketbird.com, and through the services offered on or through the website. The term "DocketBird" shall encompass both the website and the services. Your privacy is important to us and this Privacy Policy sets forth our policies and procedures surrounding the collection and handling of such information.

Information Mink LLC Collects

When you use the DocketBird website, you may be asked to provide us with personal information such as your name, email address, and telephone number. If you call, email, or text DocketBird, we may collect such personal information. You may also be given the opportunity to provide other information to us, such as your ECF and PACER login information, and the court cases in which you are involved. At your request, DocketBird may also download publicly available court docket sheets and documents from PACER and/or ECF. These publicly available docket sheets and documents may contain additional information about you, your clients, and the cases in which you and your clients may be involved. The information that Mink LLC may collect is collectively referred to in this Privacy Agreement as "Personally Identifiable Information" or "PII."

Mink LLC also uses web analytics software to track and analyze traffic on DocketBird. This information includes, but is not limited to, IP addresses, geolocation, email addresses, case information, browser/user agent information, and detailed user activity.

DocketBird is not intended for use by children under the age of 13, and Mink LLC does not knowingly collect PII from children under the age of 13. Use of DocketBird requires that you register and/or create an account ("Account") or use the website as a guest.

Mink LLC's Use Of Collected Information

Mink LLC uses PII to create users' Accounts, to communicate with users about DocketBird, to offer users additional products and services, and to make offers and promotions to users. Mink LLC uses stored PII to customize its services for you, and to improve its services for its users. You may request that Mink LLC cease storing certain PII at any time, but you might not be able to take advantage of certain customized features. Mink LLC may share PII with third parties, including law firms, for those parties' commercial purposes, including without limitation marketing. Mink LLC may also use PII to enforce DocketBird's Terms of Use.

When you use DocketBird to download a publicly available docket sheet or document from PACER and/or ECF, Mink LLC may make that docket sheet or document available to other DocketBird users. Mink LLC may also make that docket sheet or document available to third parties through other means, such as other products and services offered by Mink LLC.

If you access a payment form on the DocketBird website, or provide PII such as your name and credit card information, that information will be sent to our payment processor, Stripe. Stripe will collect, store, and analyze your PII, and will also track and collect information regarding your device, such as IP address. When you request DocketBird to remove case materials from public view, we may display a notice that the case materials are hidden or unavailable because someone requested us to hide them or make them unavailable.

DocketBird uses cookies to remember users and to enhance their experience with DocketBird. For example, when users with Accounts return to DocketBird, cookies identify those users and allow DocketBird to make use of certain user-specific information.

Mink LLC may disclose PII pursuant to subpoenas, court orders, or other requests (including criminal and civil matters) if we have a good faith belief that the response is required by law. This may include respecting requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law under the local laws in that jurisdiction, apply to users from that jurisdiction, and are consistent with generally accepted international standards. We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect ourselves and you from people violating our Terms of Use.. This may include sharing information with other companies, lawyers, arbitrators, courts or other government entities.

Mink LLC's Protection of Certain PII

Mink LLC uses security measures to protect your sensitive PII from unauthorized access, destruction, use, modification and disclosure. Unfortunately, even with these measures, Mink LLC cannot guarantee the security of PII. By using DocketBird, you acknowledge and agree that Mink LLC makes no such guarantee, and that you use DocketBird at your own risk.

Accessing and Correcting Your PII

Registered Account holders can access and change their own PII by contacting Mink LLC's privacy officer at: info@docketbird.com

Privacy Policy Amendments

Mink LLC may change this Privacy Policy at any time by posting a new version on this page or on a successor page. The new version will become effective on the posting date, which will be listed at the top of this page as the effective date.
